Information on the new tenancy regime in Scotland.

From December 2017 a new private residential tenancy will apply in Scotland as part of the provisions of the Private Housing (Tenancies) (Scotland) Act 2016.

The new tenancy replaces the Short Assured and Assured Tenancy regimes – from 1 December 2017 onwards all new tenancies in the private rented sector will be private residential tenancies rather than short assured or assured tenancies.Any short assured or assured tenancies which have started before 1 December 2017 will not be affected.

For the avoidance of doubt, this will apply to tenancies in the private rented sector, but not to halls of residence or Purpose Built Student Accommodation.
